Major Site Plan Application

A major site change is a change that alters or creates a major alteration of the same site from a number of prior use or other historical data that exist on the site. These changes can include but are not limited to structural changes such as the addition or re-purposing of the existing use of the property, or it can also be the removal of physical features on the site such as trees, sidewalks, parking lots, driveways, etc. The size of the overall area affected by the change can also affect the classification of a Major site Change. When this occurs, it usually results in a zoning case file change which will need to be submitted to the local zoning commission for review.

The purpose of a Major site Change is to change or add something to one or more of the currently used or existing sites on your property, usually changing one or more of the physical features on the site. For example, if you are a Realtor who has your own property and want to add a room to your property to allow another tenant, you would first submit a Special Site Change to the local Tax Assessor with a Swm 4 (statement of additional fee required) and a copy of your current property tax map. Your tax map should have the address of the property (including the lot number) as well as the zoning map number for the current lot you are proposing to change and the proposed new lot number. You would also provide a description of the proposed change, including any setbacks, restrictions, or limitations.

If you have submitted the above forms and are still unsure of the outcome of your request, the law firm of Lewis & Scholnick can help. They have experience in all matters involving site modifications and they are aware of all applicable local and state laws and restrictions. They also have staff that are experts in conducting both legal research and negotiations. Their team of expert negotiators is knowledgeable in all zoning matters and can assist you in preparing all the necessary paperwork and filling the appropriate SSA forms.

Once all the necessary documentation has been submitted, the Assessor will determine whether your proposed changes will be accepted or not. If your proposed change is approved, the letter of approval will be printed on a document that is attached to the property and given to you by the Assessor. On the same document, you will be instructed to sign and return the signed form. The letter of approval should be submitted along with the completed documentation and printed name date (which is typically two weeks from the date of your initial visit). If you disagree with the Assessor's decision, you can appeal to the Zoning Administrator (usually designated as soon as you receive the signed letter of approval). You should expect to pay a reviewing fee in addition to the attorney's fees and other costs incurred by your firm for drafting and filing the documentation. Review fees are non-refundable. The amount of review fee that you will be assessed will be discussed in your pre-settlement litigationainer with your legal counsel. If the court decides that your request for a minor site change is justified, then you will be granted the change; otherwise, your request will be denied.

The final steps of preparing your Major site plan application involves submitting your completed documents to the appropriate agency. The NPDES permits that the designated primary contact person (typically the local Zoning administrator) is listed on all legal documents referring to your Major site plan application. In this manner, the right-of-way engineer and/or architect that served as your legal counsel will have had first-hand knowledge of the legal authority you have been granted. It is important to note that all legal documents referencing your project information must be signed electronically in an authorized office and in a properly certified manner.
